    You need a plan of action not this that or the other. First you need a written breakdown of the fees. Second who were the HCEO Co + what was the name of the attending Agent. You also need to decide whether to apply for Set Aside or not, if granted you will be repaid all monies including fees & the CCJ will be wiped from your record.

    Have you asked to see if your original creditor has actually sold the debt on? If not then Higgins should have written to you first as they would have been acting on behalf of the company concerned.

    What paperwork were you left when the Agent called - is it possible you can scan & post it removing anything that can identify you.

      It's charged on the £2600, the first £1000 is disregarded.

      i am VAT registered, does that make a difference? or do you mean the company? i will ring them now for a full breakdown and ask if they are VAT reg.
      No, I mean the bailiff or company needs to be VAT registered.

        The fees will be:

        £75 = compliance stage fee

        £190 = first enforcement fee

        £195 = 7.5% of £2600

        Total: £460

        If VAT is added then the total is £552

        By your first post, he has charged you over £2100 in fees. Scoundrel.

          You guys really are fabulous, thank you so much. I am armed (with info) and dangerous (as dangerous as a feisty 5ft4 girl can be) and I intend to whoop some butt. I am going to try and claim for damages too (the publicly announced CCJ in the national trade magazine has meant i'm having trouble getting suppliers on board, a bit of a pain when setting up a new shop... not to mention the stress/lack of sleep and subsequent stress spots)... whilst i'm on a mission... so today i'm calling some solicitors. If anyone can recommend one that takes on this kind of case, it'd be much appreciated.
