  • Esub v MET - Won

HI, I don't know if I'm doing this right, this is my first time on these forums, I couldn't even find a 'start new post' tab.....but basically i was given a Parking Charge Notice for overstaying in Mcdonalds car park on Trafalgar Way, it was nighttime and did not see any parking signs, besides i didn't even know there was a time limit to how fast I had to eat my food, also the cars registered keeper is my mother, so the letter has come addressed to her, but i was the driver.

Can i simply copy and paste your response below and ask for the POPLA code from them

    [ Dear Sirs,

I, as registered keeper, wish to invoke your appeals procedure. The driver was a customer of McDonalds and did not see the signage. In any event the charges are penal and not a genuine pre estimate of loss as well as being an amount larger than permitted under the BPA code of practice to which you subscribe.

I will not name the driver as i am under no statutory obligation to do so.

Please accept my apeal or supply a popla code.

    Yours etc ]

      Hi Esub, to LB!

If you want to start a new thread, there is a link at the top left of the page (here: http://www.legalbeagles.info/forums/...Charge-Notices) - however, the letter you have posted seems good to me :tinysmile_twink_t2:

As Mystery1 says above (post #2) if they reject your appeal and supply a POPLA code, then edit the letter (found here: http://www.legalbeagles.info/forums/...-Appeal-Letter) to suit.

          Re: MET Parking Services advice

          Hi guys,

I just got my 1st appeal letter rejected by MET Parking, they have provided me with a POPLA form and code. Just a reminder to all helping, I went to Mcdonalds near Canary Wharf, Trafalgar Way and got sent a PCN notice for overstaying.

Before I copy and paste Mystery1's template, what box should I tick on the POPLA appeal form?

They have given me 4 options to choose from:

1 - The vehicle was not improperly parked

2 - The vehicle was stolen

3 - The parking charge ticket exceeded the appropriate amount

4 - I am not liable for the parking charge

I thank you all in advance for your help

Also I have removed all instances of Parking eye and replaced with MET parking, except for this bit

''Parking Eye v Smith (Manchester County Court December 2011) and UKCPS v Murphy (April 2012)''

IT WORKED!!!! thank you Mystery 1 and everyone else who helped, I followed your advice and it worked, they cancelled, MET Parking failed to show any proof on appeal so POPLA cancelled the ticket.

                      Thank you
