  • Debts that are statutory barred. what to do

    HI Everyone,

    Thanks for all your help with my previous claim. I have got couple of debts which are 6 years old and are now statutory barred as well as they are off my credit file.

    I am got a letter today asking me to pay for those debts by arrow global. what will be the best course of action. I can do.

    Hope someone can help me with that please.

    What were the debts for, when were they taken out and when did you last pay anything or formally acknowledge them?

      Arrow Global has a fair sized portfolio of very old debts that a surfacing gradually over the last few months.

      SB = 6 clear years without any payment (to anyone) in regard to the debt., also no unequivocal written acknowledgment should have been made, if you are sure of the dates/time scale send a letter to the Compliance Manager at AG stating that you do Not Acknowledge any such alleged debt and that it is statute barred so you will not make any payment or offer of payment now or in the future.

      Use signed for post check delivery.

        Letter example for you to write back to Arrow with xxx



        Dear Sir/Madam

        Re: Account No/Your Ref:

        No debt is acknowledged to your company yet you have contacted me regarding the above account.

        As I am sure you are aware, under the Limitation Act 1980, s.5 “an action founded on simple contract shall not be brought after the expiration of six years from the date on which the cause of action accrued.”

        No correspondence/payment/acknowledgement of this debt has been made within the last six years and accordingly unless you can provide evidence of payment or written contact from me in the relevant period under s.5 of the Limitation Act 1980, I suggest that you are no longer able to take any court action against me to recover any alleged amount claimed.

        Furthermore, the FCA Consumer Credit Sourcebook (section 7.15) states that "Notwithstanding that a debt may be recoverable, a firm must not attempt to recover a statute barred debt in England, Wales or Northern Ireland if the lender or owner has not been in contact with the customer during the limitation period." and that ''A firm must not continue to demand payment from a customer after the customer has stated that he will not be paying the debt because it is statute barred.''

        I await your written confirmation that no further contact will be made concerning the above account and confirmation that this matter is now closed.

          Thanks alot for all your replies.
          the debts are between 1 - 3k. According to my credit file the were defaulted around june 2008 but i am sure i stopped paying when i lost my job around december 2007.

          I have not paid anything since then but remember going to citizen advice for help and gave them few creditor details.

          That was back in 2009/2010. I don't know if that have reset the sb clock. Because its some time so cannot recall exactly what they did.

          I don't know if its better to send cca, sar or simply send them sb .

          Hope its enough information

            I'd send the SB letter, and also separately send a CCA, also stating you do not acknowledge any debt at the top of the letter.
