    Hi Guitars - It's the result of lots of years of hard work by us, and the Hatosag ruling in the EU court has helped hugely, as has having the best barrister and passionate consumer advocate in our corner ( Tom Brennan) . It's not going to change things overnight and there is an appeal hearing on 22nd and then 29th October. So patience is asked for. Lloyds will fight their asses off to ensure we can't get this into the court of appeal and set a binding precedent. All we have at the moment is a county court judgment, which can be persuasive.

    Have a read of the Oliver-Foster-Burnell vs Lloyds Judgment and of the Hatosag judgement ( http://legalbeagles.info/nemzeti-fog...avkozlesi-zrt/ ) The EU judgment is NOT directly related to bank charges / overdraft fees etc at all, but it enables us to use unfair terms on a different part of the banks contracts that allows for the charging of the overdraft fees.

      As I have had lots of overdraft fees with Halifax and Nationwide Is there anyway that they will refund all of the overdraft fees that I have had I had a refund of fees from Halifax £100 odd but there was £1680 odd of fees and loads with Nationwide. Out of court at all I sent a letter to the FOS but Nationwide said that they will not refund the fees.

                  Hello,

                  As mentioned, there is a hearing on Wednesday about my case, the good people here will be updating the forum on the day.

                  However, a decision isn't expected on the day.

                  I don't think there is any harm in writing to them quoting my case advising them that you believe it applies to your circumstances and that you will take the matter forward if you can't reach an agreeable settlement.

                  Someone tell me if I'm wrong?

I'm annoyed myself that I've asked solicitors but they will charge you £180 an hour to help if you can get a probono lawyer or someone who can help then they can take the case to court and hopefully win. I had help from this site which I am very grateful CAB were'nt very helpful Trading Standards said that I didnt have a leg to stand on until I researched information on Sections 5 and 7 of the consumer protections of the unfair tradings regulations the lawyers that I have called some were helpful some were'nt It just annoys me to think how can people afford £180 an hour we cant in financial hardship. I will keep fighting my case and help people like yourself and other people out.

                          Thanks for that Amethyst. I had a brief look, but as with most documents of this nature it's not exactly enjoyable reading! I shall check again in more depth.

                          Apologies to all for being away, work issues had distracted me but I'm interested to see where we're at now. If anyone has any additional information on events since October I'm keen to hear.
