    Oh my goodness, thanks soo much for this information. Yes the statements I got yesterday are full of opinions but now I will challenge as didn't know I could do this!
    I made sure there was a simultaneous exchange of statements and sent mine 10 mins after I received theirs. Lol
    It seems the judges here are also unlikely to strike out the case as in my research have noticed in previous tribunals the same issues but nothing ever done! I will be writing to the President of the Tribunal Service after this is finished about the Judge, (scared to now as Tribunal next week lol) Also don't want to say where I am at the minute in case PBS are monitoring and I get into trouble? Lol!
    Also they still aren't giving me documentation but I have raised this!

    Dominic I just want to say how grateful I am for your response to my post.
    I have challenged statements provided and have printed out everything you've said so I can use it in the Tribunal next week I.e about the use of 'my client believed'....I will be using your info a lot I can imagine lol! I wouldn't have known any of this before hand! I think it could be the difference between winning or losing! Thank you

    Hi, just wondering if anyone would be able to advise? Received witness statements via email from Peninsula however they are not signed! I said to 'consultant' from Peninsula and he said, 'yes, we just take them as signed'? I'm assuming he's going to get the witnesses to sign them on morning of Tribunal! I have a CMD to discuss problems I've had with Peninsula (as per previous post). Can I refuse to accept these witness statements given they aren't signed? The witness statements were ordered to be exchanged last week and were. Thank you

    You can't refuse them but you could raise the issue at the hearing and the tribunal has discretion whether to accept them or order them to be signed. The Witness who signs the witness statement is saying everything in there is from their own experience etc ( usually in the top few lines there is a declaration ). It isn't unusual for the barrister/rep to write the witness statements but the witness signing confirms it is all true to the best of their knowledge. So you can question the witness based on their WS. If there is more than one witness, are the statements identical or very similar ?

    Thank you. The Tribunal witness statements are different but on that point there was 6 statements taken at the disciplinary proceedings stage and they are identical and weren't signed....the manager signed them all! I was going to bring this up and argue that there wasn't a proper investigation carried out and these being used as evidence was unfair?

    For some reason my posts seem to disappear on this forum, but i'll try again. I'm am very happy with Peninsula and have been for the past 12 years. I'm happy to talk to anyone and share my experience of using their service.

    It is fantastic to hear a positive experience, we are aware there are many happy customers of PBS - but as our forum primarily tries to assist people with problems we tend not to hear much from satisfied consumers.

    You might be able to give another viewpoint to some of the issues - if you have had a read through the threads ... mostly it does seem to be the initial contact, sign up and the rolling contract as opposed to the service, although there are a few concerns regarding tribunal representation it is from the employees viewpoint in the main part rather than the employer ( pbs's client)

    In response to reviews raising the issue of the contract duration you've repeatedly stated that:

    A number of issues posted by clients of PBS on this thread have now been resolved directly between the parties and, as such, they have requested posts to be removed.

    It is great to see companies like PBS contributing to the forum and being proactive in assisting clients, and although it is a shame the agreed resolutions to client issues posted on here are not being shared with others, I'm hoping that PBS may see their way to create a FAQ to assist future clients who haven't been able to sort out problems directly with the standard PBS complaints channels.

    Totally agree with you, their are a host of customer reviews regarding their practices and the way they operate! Us the consumers (lay people) end up having to pick up the pieces with or without legal assistance.

    Once you sign up with them, its nothing but a rollacoster ride from the beginning but don't know where it ends!!

    Has anyone actually taking been taking to Court by these people or the other way round regarding the Contracts they sell!!

    Fact of the matter is their Sales Staff fail to make customers aware of the fact of that they are not SRA registered or regulated., and they fail miserably on failing to fulfil what they offer verbally or the written terms of their contract. Say one thing and deliver another

    We made several attempts to make contact with @MEME1981 when they originally posted, unfortunately, we never received a response. I am pleased they did contact us via private message overnight and I've given them the Directors Office contact details so we can get their situation resolved.
