    Hello
    I need some advise on how to stop Lowell from sending me a letter asking me of say old agreement with Three mobile in 2010.

    About three years ago I have discovered that a payment of £30 a month for nearly lasted for two years, went to Three mobile from my NatWest bank account. I was not aware that I had set up a contract with Three broadband and phone. So I complaint to the bank and shortly after the bank refunded the amount of £565 to me and I have cancelled the direct debit with Three mobile. Recently i have been contacted by Lowell asking me of the amount they claim I owe them, as they have been aked by Three that I have signed a contract with them in 2010.
    I have written to Lowell asking them to provide me with detail of the contract, and any usage bills from Three mobile and gave them 14 day to persons. Unfortunately they didn't provide me with any details, instead they have asked me to pay £10 to get the details from Three. After the 14 days elapsed have sent email to Lowell asking them that stop hassling me with any letters or emails asking me for payment.
    My question would Lowell have the right to take me to court?If they can what will be my next move and appreciate any advice.

    Personally, I think you should send a 'prove it' letter to Lowells. If you have not admitted any debt to Three, then Lowells have to prove you actually owe the money before they can collect.

    Would a CCA request work for this (enclosing a £1 postal order)?? - I am sure other Beagles will be able to advise on this:tinysmile_twink_t2:

    The £10 they are asking for could be for a SAR request, which (IMO) is not needed (at this stage).

    I am sure others will be along with advice soon!

        Irritatingly the CCA Part V (ie the CCA request and unenforceability bit) doesn't apply to mobile phone contracts such as Three.

        However a prove it letter would be a good idea, they still have to evidence you have a contract with Three that money is legitimately owed upon.

        They are asking you to send a Subject Access Request under the Data Protection Act, well you could to get the full details of the debt and what's happened since the refund - that would take 40 days to get the relevant information - and you could ask Lowell, as it was their idea, to put the account on hold while you obtain the relevant information. And once you get the information from Three you can use that to sort out the account and maybe get it recalled from Lowell if it was an error on their part, and also use it to get any markers on your credit file fixed if appropriate. I think it would be worthwhile doing that as the issue is bigger than a straightforward debt.

        Do you have any letters from Three and the bank from the time you were making the complaint about the errroneous contract and DD ?
