    Hi,
    My parents lent a company £4500.00 paid direct to the business account with company name as reference
    The company was run by elder brother and wife.
    Elder brother and wife split up some 2 weeks later
    Wife said payment would be made
    payment not received
    Parents took court action against the company

    wife defence is saying that money lent to brother not company.

    is the fact it was paid to company, that the ref was the company name and that she stated in 2 sms that payment would be repaid. enough to go to court on?

      They have filed the defence, and the court have given them until the 15th to file the N180
      I can upload the defence and claim if needs be blanking out the names?

      Her solicitor has written saying, if we go to court we will lose and have to pay their cost of £2,600 - 3,700 +vat

      the company is trading; elder brother had to resign due to divorce proceeding.

        If you want to email the defence and particulars will have a look. Her sols costs sound extreme for small claims. See CPR 27
