  • Parking charge from Excel Parking

    Hi all,
I need a bit of help please,
Basically my mother in law and I were in town on the 18th August shopping and my husband pulled into an open pay n display car park to wait for us to take us home, he pulled up to the front of the car park to wait for us and where he parked to wait is just like a small road with no parking bays marked out,
I called him to find out where he was and when I told him that he's not allowed to park in there without paying he left,
The letter has just come through the door with a £100.PCN reduced to £60 if paid within 14 days
It states that on the 18/08/2014 he entered the car park at 15:06 and left at 15:22 on the same date,
I think a £60 fine for 16 mins is WAY excessive,
The problem we have is that he knew it was a pay n display car park but thought as he was only sat there waiting in the car plus not actually sat in a marked parking bay he was ok,

What should we do? Just swallow it and pay or fight against it on the grounds he was there for only 16 mins and was sat in the car in an unmarked bay/road?

    Any advice is welcome,

    TIA Sam x

      I hope so, I don't really want to pay a £60 fine for a 16 mins stay, it's ridiculous
      thanks x

Appeal and when that's rejected appeal to popla.

        Dear Sirs,

I, as registered keeper, wish to invoke your appeals procedure. The driver did not park and never left the vehicle. In any event your charges are penal and not a genuine pre estimate of loss.

I am under no statutory obligation to name the driver and will not be doing so.

If you reject my appeal please supply a popla code.

        Yours etc

For a popla appeal edit http://www.legalbeagles.info/forums/...-Appeal-Letter or http://www.legalbeagles.info/forums/...-Appeal-Letter to suit and it'll be all right on the night

          Awwww thanks,
quick question, if all is rejected do we get to still pay the £60 or will we have to pay the full £100?
Should I add on there about it being for only 16 mins plus not even sat in a marked bay?
          TIA Sam x

They'll seek £100 once their arbitrary appeal deadline is passed. We'll seek out a picture of Harvey Smith in reply though.

It says I have to appeal in writing within 28 days, does this also include email? x

                        Hey all,
just a quick question regarding the above,
I sent me email to form a complaint about the parking charge 2 weeks ago today, should I have heard from them by now?
Should I call them or just sit and wait?

                        thanks xxx

I would call them to see if they've got it.

I've just re-read the automated email that I received and it says they will respone to us within 35 days, If I call them is there anything I should avoid saying/telling them?

If you have an autoreply and thus know they got your email then i wouldn't worry.

If you call them don't admit anything, especially who the driver is unless they already know. Ask the question you need an answer to. Keep it short and sweet.
