    Hi All,


    I had an account with virgin back in 2004. Due to my financial situation I could not keep up with payments and started missing payment around march/april 2008.


    I got a letter last week and got another one this week saying it will be passed onto scott call and they will visit my house to recover the debt.


    I had a look through my credit file and it says that I started missing payments in April 2008 but they put the account in default back in October 2008 which was after the 5th continuous missed payment in September 2008.


    Any help will be appreciated. Shall I start by sending CCA and SAR requests.


    Please advise.

    Would this be Statute Barred now?? or at least nearly there??

        Well ... you could start off with the CCA and SAR requests, but personally (as it looks to be so close to statute barred anyway) I would be tempted to hold off and see if they actually do pass it on to a DCA :tinysmile_twink_t2:

            I'd hold off too, although you could argue it back to probably June 08 you'd be better off keeping shtum for now and if you get a further letter to simply respond with a statute barred letter.

              Thanks alot for your replies. It was actually Lowell who sent a letter saying it is being passed to equidebt and then equidebt who has transferred it to scotcall by saying one of the debt collector will visit me from ScotCall.

              But just incase if someone does turn up at my property. What will I do then or say to him?

                Don't let them in. Ask to see ID (you can talk through an open window or even the letter box :tinysmile_twink_t2 or refuse to talk to them. Don't sign anything. Don't admit the debt.

                If you get another letter, do as Amethyst says and fire off a Statute Barred letter (posted signed for/recorded - costs approx £2)
