  • ParkingEye parking charge notice

We have received a parking eye parking charge notice for overstaying at a grocery store after doing our shopping. Are these enforceable? Do we pay? I have no idea what to do. Thanks

    Re: ParkingEye parking charge notice

You should appeal it and also go see the grocery store management and kick up a fuss. The grocery may sort it on production of your receipt.

An appeal to parking eye should be along the lines of :-

    Dear Sirs,

I, as registered keeper, wish to invoke your appeals procedure. The driver did not see any signs and was a genuine customer and i attach a copy of a rceipt as proof. In any event your charges are penal in nature and not a genuine pre estimate of loss.

I am under no statutory obligation to name the driver and will not do so.

Should you reject my appeal please supply a popla code.

    Yours etc

If a rejection of your appeal is received use http://www.legalbeagles.info/forums/...-Appeal-Letter which should be edited to suit before sending to popla.

    It does work http://www.legalbeagles.info/forums/...pany-victories

Are the charges enforceable ? Some courts say yes and some say no. There is currently an appeal on this point to a higher court which will be binding on lower courts when decided.
