  • Mkdp v resigned director

    I resigned as a Director in 2006 and am now being pursued for an alleged company debt. The company was still trading up until 2009.
    I started receiving demands from MKDP in 2013. Am I liable for this alleged debt? They have started court action against me.

    I think we need a little more information about the structure of the company? was there any personal guarantees etc?

      Sadly yes. The debt was an overdraft. All overdraft renewal correspondence however was always addresses to The Directors.

        Did you sign a Personal guarantee for the overdraft if you did you may well be liable and should seek advice.
