    Ive just had a reply from BrightSpark saying basically Ive signed up for a loan with Carnegie Consumer Finance Limited and its up to them to cancel the loan its nothing to do with BrightSpark, Im going to contact CCF and explain how BrightSpark sell the course to students is now how they actually run the distance learning part, and BrightSpark have confirmed that their representatives that come out to the home visits receive a commission on students who pass the course which is why I'm beginning to think they bend the truth a lot to suit the student to what they want to here. Surely if its CCF that give the loan outthink you should have a visit from them before the loan is given out? but the financial aspect is secondary to why i want to cancel the level of support and guidance you get from BrightSpark on the distance learning is terrible compared to how it was described on the home visit, Ive done my from 12 distance learning TMA's and not once been contacted with any guidance etc after been told the tutors stay in regular contact, Im pretty self motivated but what are they charging me the £6600 for?

      Indeed, the first visit is arranged by telephone. That visit usually does the marketing of the course, and there's usually a second meeting for the loan sign up. I believe that is to get around the not canvassing off trade premises part however they don't appear to get a signed request for the second meeting.

      If you are au fait with s.48/49 - it applies to debtor - creditor - does that also apply to debtor-creditor-supplier agreements? - I keep coming back to the example of Double Glazing home visits and sales of finance - so if you have a bit more insight it would be gratefully received.

      And no, the loan/finance details are not clear in advertising - neither is the overall price tbh, so no way of knowing until the sales guy is in your front room.

      Also they seem to deny the amount they charge publicly - despite us having seen many agreements for between £5k and £8k.

          Amethyst, did you find out anything more about s48/49 and the second visit?
          I am trying to help someone who had a phone conversation then one visit only where he signed and was hoping his one visit would qualify him for a 'miss-selling' get out!

            which is odd for a lead gen company. The sites give no details of the name of their company, or co house details or anything really to tell you who you are giving your data to.

            They also share testimonials.

                  I don't think so, however it does show how much marketing goes on to get people into these courses and not all of it is entirely transparent as to who you are actually dealing with.

                      It depends if it is directly relevant to your case - ie when you first contacted the company did you do it through one of their websites?

                      Carnegie Consumer Finance would be liable under section 75 - you've already complained to TG haven't you and got nowhere?

                        help needed signed upto trades gateway on an electrician course last august payed the monthly payments up till last month when circumstances changed rang trades gateway to cancel course where i got a very rude operator with a very bad atitude who said i was past the cancelation point and couldn't cancel. I rang Caledonian Consumer Fiance who just said i need to pay the loan back and sent me a income and expenditure form out to fill in and send back

                          It is like any other loan, unless there have been serious misrepresentations made to you with regards entering into the loan, then you need to repay it, as with any other loan if your financial circumstances change you can negotiate repayments to be more affordable.

                          Are you still studying the course? Have you got to any of the practical elements yet ?

                            Amethyst, you are correct, however, to protect the consumer who enters into regulated loans in their own home, the government has legislation, and policing bodies, such as the FCA to ensure full compliance.

                            In the past it was to easy for so called "loans sharks" to pray on the vulnerable, elderly etc, by arriving at their homes to offer finance on items like, double glazing, loft conversions, new conservatories etc, they all were convincing silver tongued salesmen, who after protracted emotional pitches persuaded the home owner to sign a loan document, which many never read correctly or failed to understand the implications of their signature on that document, which was cleverly crafted to protect the salesman.

                            The government realised this was the case, so the emphasis of legally signing a regulated loan away from business premises in your home was then placed on the provider....not the signer. i.e the sales person providing the loan had to be correctly licensed to do, which is policed by the FCA, and can be checked via their web site...

                            So in a nut shell, forget about checking through the small print on loan documents, the first legal check must be with the salesman, a person having concerns about any loans provided in your home for home improvements etc, must first ask the salesman for full identification, and to provide you with details that he holds a valid licence to arrange regulated loans away from business premises, if the salesman works for or represents a company, the company must also provide current valid licensing details for that sales person.

                            If that licence is found to be invalid or out of date on inspection, then any regulated loan set up by that sales person will not be enforceable, and the consumer I presume will be entitled to be made whole, i.e full rescindment of that loan.

                            And as you say if everything is in order, then all loans take out 'MUST' be repaid as contractually agreed by the signed document..

                              Indeed, I have brought up the issue of no permission for canvassing off trade premises with regards the various companies and the sales reps being affiliated to TG rather than the individual lenders.

                              Marlborough Information Services credit licences lapsed 01/07/2016 and they had 'No right to canvass off trade premises' ( inc trading names
                              Train 2 Game, Trade Career, Trade Jobs Info, Atl Practical Training, Trades Gateway;BrightSparks Welding )

                              However Career Finance 4 Trade Skills Limited do have the Right to canvass off trade premises

                              The Salesreps are from Marlborough. The question is are they also from CF4TS and licenced that way ?

                                I am currently in the exact situation, always had my doubts about CF4TS! I was randomly contacted by them last year, told the agent could come to my home and ended up signing up, after the 60k a year speech, lack of welders ect ect. I text the guy who came to my house who apparently was from the 'collage' and he replied with, he doesn't work for them anymore, they owe him money, and went on to say how things where okay at first but in the last 2 year things went down hill and no one was getting what was on paper, he dosent even know who the FCA are or if he was covered by them either! ive payed almost £2000 of £6500 for this advanced welding course, and I was told I would have my own tutor who would help me along the way who I have never heard from, and that I would have as much time as I needed to complete the course, but it turns out I only have 18 month left, I want my money back, the course cancelled and to expose this awful organisation. any help would be greatly appreciated, thanks guys!
