Received a county court claim form on Saturday (31/05/14) from my previous internet provider (Home Telecom). Would like some advice on how best to proceed.
First this came out of the blue, I have not received any letter before action from them (nor any other letters for that matter). And as I have been at the same address since first signing up with them it could not have gone to a previous address or anything. Should I mention this as part of my defense?
They claim I owe them just over £150. Particulars of claim state "Site ID - #####, Phone and Broadband Services, Feb14 invoice, Total owed #158.40". I transferred my ISP at the end of December which cancelled the contract with them. I had been with my previous ISP for some time and was not locked in to a minimum term contract, just 30 days notice. They took payment for the December bill in January 2014.
I have been able to log into my old account and see that there is a bill for February on my account, seems they are charging me for an engineers visit. I did have an engineer callout in November so presume it relates to that, but this should not have cost anything. Haven't had any details about this bill.
I presume I must respond to the claim and put in a defense, but should I get in contact with the ISP or is it too late now they have started this? Any advice would be appreciated, not had to deal with this before.
