          I must correct you here and please everyone note that ATOS "will try it on".
          As quoted by Mike Penning, who was Minister for the Disable at the time!< to the DWP PIP committee hearing on 11th December 2013, you can find it in full as the answer to Q75 from the committee, although I have not sure about his mental capacity at the time as he was very confused when he got to Q80 and thought it was about WCA, not surprising really as almost anybody looking at the 2 processes would see them as the same.
          Of course, some people
          are requesting to tape their appointment—and they are entitled to do so—on recording equipment,
          so that sometimes is affecting how long a consultation takes place

          At my assessment, at home today, with an power extension cable available for them, the assessor arrived at 10:30.
          I asked Jill, to wait while I turned on my pocket recorder and the problem started. THEY had been informed by me 3 times, regarding my recording recently, let alone in the past, the DWP failed to provide the prior evidence at a previous (recorded, which I have) PIP assessment, to my tribunal hearing.
          I have given them permission to record it, but I regret that they cannot have my only copy. They can supply there own, to use their, incorrect, expression "The cost of making the recording rests with the customer, as recording is not requirement of the DWP".
          The last bit is correct but they CANNOT stop you recording, if they want a copy then THEY can provide their own equipment, just as they say to you to deter you, they are and will be in breach of contract should that take any action against you regarding recording.

          I am very angry in the way ATOS make up rules, they know of me and that they cannot make up rules that are not part of their contract with the DWP, they cannot implement and use them to force you to do what they WANT, that is coercion at best, threatening behaviour at worst.

              ATOS got out of the WCA assessments a few months ago and promptly got awarded, the bigger money contract, PIP assessments which is what I was supposed to have today until Jill walked out of it. They are not going to stop me recording it, the first one ATOS did the assessor lied and from that point on I have insisted, as is my right, to record it. Recording concentrates the assessors mind on getting facts right, as they know the consequences.
              CHDA now do the WCA assessments for ESA, which I have also got on the go, the DWP have really got it "infamy", probably because I am a very stubborn (Victor Meldrew?) person who will not be walked over, not without a fight and they hate being on the receiving end of my broadsides.
              I have also made a FOI to the DWP to see the current contract with ATOS as the previous one required ATOS use, current GMC registered (doctors) people, Jill, today, was not on the GMC register but the new contract may allow it, I will have to wait and see.
              If the new contract is a repeat of the last one, then anything ATOS say should be thrown out, if it has to go to the tribunal as it was not a valid assessment, according to the GMC rules.
              On a lighter note, when I called the PIP line a few months back to declare a change in circumstances, after all, it is required by law or I would be penalised Ł50, she seemed very disappointed when I said my condition is considerably worse, seems like the change of circumstances rule is only to be used if you get better, sorry but the LAW says I must tell them.

                I need to maintain eye contact because I'm deaf - no lipreading, no communication!!

                I really do not know and will ask the decision maker if ever they do ring me like I requested...I guess it shows confidence or mental stability, then again a pshco would stare them out and shine at this , I dont know but my excuse to the decision maker is that I was in love , it for me was love at first site when I saw that asseser women and I just couldnt keep my eyes of her and with the eyeing up of myself by the assessor I thought it was a mutual attraction...then again, I could have a perverted medical condition were I only look women in the eyes and ignore all men...or...I thought the assesor was possessed by demons and I was trying to look into her sole, coz ya can if ya mad lol...I dont know which excuse I will use but at the end of the day maintaining eye contact does not nessaceraly mean all is good and I will let this be known.

                    Hi and welcome, I can give you some advice from CAB HERE, there are also some sites that you can go on that give a form you can go through to check if you are eligible for PIPs.
                    If you have a Google you will find lots of info and also others experiences with their claims, good luck and please let us know how it went if you can.

                        Fact is I cannot move 1m without pain and discomfort due to spinal problems ,I have slipped 2 discs with one borderline requiring surgery as it has recently affected my bladder...Activity brings on my symptoms and now I am being investigated for CAN, which is basicly very bad effecting the heart...my internal organs can fail at anytime is how i see it, activity increases the chance...Someone like me needs a blue badge and benefit help in the way of PIP...My GP agrees and once I see my neuroligist again he I am sure once informed of the Atos and DWP decision he will agree, and hopefully in disgust write me a free letter.

                        Thing is PIP is a benefit for me, I deserve it as it was designed to give people like myself independence...But eye contact, showering and getting to the appointment was all used against me in the decision makers letter.This decision would if I let it stick interfere with my rehabilitation and it most certainly would help destroy me mentaly as I have already been house bound unable to afford the costs of leaving the house for 7 months already.I cannot use Public Transport even if it was available.

                        So...If you can get someone to lean on as you walk to there office, and of course they drive there not you...and dont maintain eye contact with the assessor, and smell as much as your body allows...you might just get what your rightfully entitled to...Goodluck.
                        May i ask the likely qualifications of the assessor. Were they a doctor, a psychologist or another suitably qualified expert...or were they a nurse or health therapist? My point unless they're medical expert, they'll not have the skills of a suitable professional, they will tend to use legal guidance not as guidance but strict rules.

                              ok after I had a first appointment I suffer from bad knees/legs and on a lot of meds that make you sleepy I was told I had to attend a examination which is wrong anyway I went sat down waited 10 mins then was called got up and fell to the ground and struggled to get up as my legs was completely dead the examiner just looked said when your ready come in and walked off no help was given and struggled to get up eventually had to crawl to wall and lift myself up just made it into room sat down done the questions extra in 10 mins outcome I was fit for work by a unqualified idiot who said nothing wrong notes saying what happened just arrived on time in car wtf

                              demanded another assessment one came through this time got doctor to write letter stating wont attend after last incident and unfit to drive and cant catch bus due to panic attacks
                              they then wrote and offered to get me a taxi which I refused I want a home visit

                              so day arrived home visit one doctor and the assessor came down stairs and went ass over tit knees went again assessor just sat there doctor came over asked if ok and helped me
                              1st question can you raise your arm no because I suffer from a tender chest bone forget whats its called
                              2nd how far can raise attempted to raise was in a lot of pain doctor said stop can see your in pain
                              3rd question doctor turned round said I told you examination finshed you can see in a lot of pain I am not going on
                              assessor I want to check his eye sight with this doctor got up and started walking out I told you no its over

                              best assessment yet because of changes from dwp now claiming pip so will be telling them home visit or don't bother least you know theres a trained doctor that helps and puts the assessor idiots in there place
