  • County Court Costs

    A recent claim against me was sent to the wrong address. For this reason a judgment was entered. The judgment letter eventually came to my notice and so I applied to have the judgment set aside. I won the case but the judge ordered costs against me as he said I had failed to submit a defence. Obviously when I applied to have the case set aside I gave my reasons as to why it should be set aside. The costs came to £710.00. Should I appeal these costs and if I appeal do I still have to pay them pending the result of the appeal? If I eventually win the entire case will I get my costs back?

    Yes, appeal.

    In effect, you have been penalised for the courts error.
