      Give Marlin a call, ask them if they have any idea how long they expect to produce the documents. If they 'don't know', suggest they discontinue their claim. If they disagree, suggest you will give them 28 days or you will make an application to strike out their claim AND seek to recover your costs for doing so.

      Whatever you manage to agree, confirm by following up with a summary in writing. Even if they are flat out hostile and unhelpful
      , set out what was discussed, what was refused, what was agreed. Keep proof of postage. Then when you make the application to strike, you will have a chain of evidence of your attempts to get them to back up their claim with evidence. I would prefer to see a minimum of two examples of written communication from Defendant to Claimant to back up any future application you make to strike the claim.
