    Morning i wonder if someone can help me. I received a county court letter via Brethertons for a bill i had already paid.
    i sent proof of payment to Brethertons and they have confirmed the payment was made to there client. however they still want to charge me over £600 in fees as they claim they were instructed before i made the payment. now the the court letter was the first i had ever heard of these guys.

    my question is do i have to pay then?

    Not necessarily, but you need to acknowledge the claim and state your intention to defend it in full, if you haven't already done so. A claim has to be acknowledged a maximum of 14 days from the date of service, calculated by adding 5 days to the date on the claim (a total of 19 days). Once you do that, you have an additional 14 days to submit your defence. If you don't follow the process, the claimant can get default judgment against you. :scared:
