  • Non Dealing Restrictive Covenant

    Hi all

    I have handed in my notice as a trainer to move to a company to do consultancy and paper based work. So it is not the same role.

    The company I am set to move to is currently a client of my original employer.

    The original employer says that the non-dealing covenant in my contract means that I cannot even be in contact with any clients for 12 months after the termination of my contract.

    Can I still move to the new employer as it is not going to be in competition with my original employers business of training, in fact he could end up with more business as I will be highlighting further training needs that I will not be delivering.

    Hope that makes sence. Any help would be appreciated.

      I was hoping that was the case but with the research I had been trying to do into Non-Dealing many didn't mention anything about competition and just said you could not enter into any contact, initiated by you or them, with any clients for a period of time.

      I guess its just the boss trying it YET AGAIN grrrrrr

        Ask your boss to state in detail what conflicts/reasons he has to stop you from entering employment with their client. Address each point with him and ask what actions would he consider taking if you did take the job.
