Hi, an update, which I'm hoping might be good news.

As required on the notice of allocation to the small track, Lowell must file with the court and myself all documents on which they rely, plus copies of the written statements by today. Mine were sent off at the beginning of last week. Lowell's still haven't arrived.

I'm going to call the court in the morning to see if they've received anything, maybe Lowell are playing fun and games - keeping defendants in the dark appears to be a speciality of theirs reading a number of different forums. Would the case be thrown out if they haven't supplied the court with anything by the date specified?

The documents ordered will be so the Judge can look at the case and decide if any orders are needed before allocating a hearing date, so I'm afraid it will be a case of wait and see.

If Lowells are arguing against the statute barred issue then they should have submitted something, sadly they may well get away with being late, it really depends when the Judge looks at the case.

Rembrandt, Monet, Da Vinci, Caravaggio etc - great artists of some of the most beautiful works ever seen.

Alas, their masterpieces fail in comparison with the sheer beauty of the latest offering from BW Legal on behalf of Lowell Portfolio. Yes, like the joy of finding a Wonka ticket, I anxiously opened their envelope and, lo, behold, a Notice of Discontinuance!

I think I may frame it (after scanning it and keeping it for future reference in case any other DCAs come calling).

You are the second Stat Barred discontinuance today, maybe Lowell have decided their little white fibs about last date of payments aren't quite good enough to get through court.

No doubt they expect debtors to either file an admission or ignore the claim to obtain default judgment. :incourt:
