  • Credit Card Late Payment Charges - Can someone clarify current situation please

    I wonder if someone can clarify the current situation with regard to reclaiming credit card penalty fees e.g. for late payment etc. I had done this several times successfully in the past via the FOS. However, their stance seems to have changed in recent times. I got absolutely nowhere with MBNA and Barclaycard. My question is - has anyone had any recent successes with reclaiming through the courts? If so what POC was used and what arguments were advanced as reading some threads it seems as if court is not understanding argument and accepting them. If I am going to go to court I feel that I do need to be well prepared

    Are they £12 charges? If so you haven't got much chance in court I'm afraid.

      Can anyone comment further on the current situation regarding reclaiming unfair credit card charges ? I have two ongoing with RBS at the moment regarding some old fees / charges that are well in excess of £12. They have replied today commenting that I was aware of charges when I opened the account in 2001.

      These charges were between 2001 - 2006 but they have not mentioned anything about 6 years time-barred. Should I just reply with a LBA or am I wasting my time going straight to FOS with complaint ?
