    Hi, new to this site.

    I was looking for some information regarding the overpayment of Pension credit.

    My mother claimed pension credit on 6th October 2003, declaring she had savings of £3,500. My mother sadly
    passed away August 2013. A will was made in 1995 making myself executor. The property was put on the market to be sold and a equity release to be paid and the remainder to be split between me and my brother. After vigorously
    searching through paperwork all her liabilities were listed and due to be paid on completion of the house sale. We are at the closing stages of the house sale, when a letter has now been received from DWP. Information was submitted and they have now asked for bank statements for the time of her claim (9/10/2003) The bank have advised that they can only supply statements as far back as 7 years, which were received today. Although I have searched the internet and seen this is common I have yet to find out how to work out how much they will be wanting from the Estate. Can anyone help even if this is a rough estimate.

    Its difficult to get pension credit wrong but the Inland Revenue can and will demand back monies if mistakes are made. They may spread the money over the next full tax year.

      Hi JaceyVery new to this site and have just spotted your message. I am interested to know how you eventually got on with the DWP as I have just received a similar letter after the death of my mother in June who was in receipt of pension credits. She also had an equity release policy on her property and have just sold her house.I am anxious to know how far their enquiries can go back and if we have to find bank statements going back after 6 years, which we won't have.Many thanks for any helpful advice.

        I'm not 100% sure, but I believe benefit debt is recallable at any point (it isn't covered by the time limitations that consumer debt has) - if so, the 6yr SB time scale would be of no use to you
        However, if this is your deceased mothers 'debt' I'd assume they would have to prove the validity of a claim before being able to collect??
        Debt is like any other trap, easy enough to get into, but hard enough to get out of.

        It doesn't matter where your journey begins, so long as you begin it...
