  • Are they allowed to do that?!?

    Hi,

I've got myself a couple of debts. Both settled with llyods as have been purchased by some debt purchase specialists. One by capquest for a credit card and another by Lowell for an overdraft on an old current account.

I've sent both 'proove it' letters in early December and as yet heard nothing back. All calls and letters from both have stopped..... For now.

However, today I received a phone call from my letting agent (i live in rented accommodation) informing me he had just had the home owner on the phone concerned as he had just had a debt collection agency inform him of my debt and that I have a CCJ outstanding (which if true they haven't made me aware of it).
This was done by Lowell. Are they allowed to discuss such things with my landlord?

    Thanks
    Tom

No - they are in breach of their professional guidelines and of the Data Protection Act 1998.

This last also applies to the Letting Agent and the Landlord - if they mention it to anyone else, they will also be committing an offence.

No. they most certainly are not permitted to do that, even if it were true which, knowing Bowells, I suspect it is not.

It is easy to check if any CCJ has been given against you, at the Registry Trust Online (link) though getting a copy of your credit file from any of the three credit reference agencies would probably cost less and should also shew any CCJ.

First find out if the allegation from Bowells has any truth to it.

When you learn it is pure stercus bovi, you will be better equipped to deal with those buggers.

Do not merely report it to the Information Commissioner's Office, but also take it up with Trading Standards (0845 4 04 05 06) as this would seem to cast doubt on the fitness of Bowells to hold a Consumer Credit Licence.
