CCJ general form order

  • CCJ general form order

    OK got a Genreral form of judgement or order.

    it ordered the DCA to hand in all documents they rely on evidence in court by a cretin time.

    the DCA handed them in days late.

    does this mean court can struck it out?or I ask to struck it out?

    The Court generally give claimants/defendants (well non LIPs anyway) a bit of leaway on filing documents with the court. So although you could ask to strike it out it would likely be unsucessful and just cost you the application fee. You can mention their late filing of documents in your witness statement/skeletons if it is relevant (ie if you are arguing their general behaviour etc)

    Did they send you copies too?

      well they trying to sue, I am helping someone who is classed a vulnerable person mental grounds ( hence why I am helping).
      The solicitor for DCA was told of their vulnerability and they ignored it and carried on with nasty letters. We always asked for proof of debt so we would pay, and they have showed nothing.

      We defended claim, then after two weeks of the order they pass CCA to court! when after months and months we asked for it.
