  • Back dated tax credits claim

    Hello was hoping someone might have some experience in this subject.

    We started calming DLA for our son Tom who was diagnosed with Autism in September 2011, at the time we did not know that we where entitled to extra tax credits because of the recent diagnosis.

    Recently in August this year we where told that we could claim this extra money which of course would help greatly.

    So we got in touch with the tax credits and told about the situation and asked for the new payments to be back dated to the date when we started claiming DLA for Tom.

    Originally we where told that normally this can only be backdated 1 month and also when we received a review letter for toms claim with the DLA in June this year if we had got in touch with the tax credits up to one month after they would of back dated it up to a year but of course there is nothing on the letter saying we are entitled to extra tax credits.

    So today we spoke to the tax credits again and a final decision was made and we would not be able to claim all the way back to September 2011, so we have asked to appeal and where just told to download a appeal form.

    Im hoping someone has had some experience in this and have we got any chance of being successful?

    I know that a few years ago claims could be back dated for upto 12 months, but the rules did change.

    Generally speaking backdating is one month only, except when the delay in claiming is caused by waiting for another Gov dept to make a decision. e.g. make DLA claim in January, given decision 1st June. You can claim TC back to January if you make claim before 30th June, but make TC claim on 2nd July and it will be backdated only one month.

    However do try with your appeal, as nothing ventured nothing gained

    This link does say "Tax credits" MAY only be backdated for up to one month" but elsewhere reports agree "one month only"
