  • Forfeiture of Lease - repossession proceedings

    Hello

    I am seeking some advice on behalf of my sister. Basically, she owes 5k in outstanding service charges. A judgment was made in the Northampton County Court for this on 13 August 2013. On 19 August she applied to the court for a variation of the order (N245). She received a letter from the court last week saying that they had lost her application and asking her to resend it, which she has done. In the meantime though, she has received a claim form for possession of property from Lambeth County Court with a hearing date of 2 December on the same matter.

    My thinking was (and I am no expert) that as she is still awaiting a determination from Northampton County Court that she could use this a defence to the possession proceedings. Is that right and can they use two different courts to chase the same debt? They have also been threatening to make her bankrupt and also coming round to the property at all hours.

    Any help would be gratefully received.
