  • Voluntary Dissolution, application not copied to all parties.

Hope this is in correct section.

Hi, had an Employment Tribunal, Judgement in my favour in that the company does owe me wages, holiday pay, notice, etc. I started my ET claim in December 2012, the company applied for voluntary dissolution in Jan 2013 (i was still working for them in December 2012). I have manage to suspend the action with companies house due to the ongoing ET. Regarding recovery action - first action has been to wait for an offer/response from the business. Couple of weeks passed - nothing, so will refer to HCEO. When i originally contacted Companies House, i told them, there is an ongoing tribunal, I had not received a copy of the application and they were still trading when i worked there (less than 3 months before VD application). They suspended it for the tribunal but said it was not in the public interest to take it any further regarding the trading issue and not issuing a copy of the application to me. I can appreciate at the time, there was no actual debt, just a claim, now there is a judgement, an actual debt of couple of grand, company has been informed, given it a couple of weeks, no communication whatsoever. I am just about to send a copy of the judgement to CH and could do with a bit of guidance/advice. I think, ideally, what i would like to see happen is the dissolution be stopped until the HCEO have had time to do what they do and see what the outcome is. If CH will not act re the application, am i able to take the company to court (magistrates?) to show that i am serious. For extra info the director of the company started a new ltd company at the end of Nov 2012, a few days before I was finished. I am interested in the company law/companies house procedure rather than any ET issues, i appreciate there is a seperate forum for that. Thanks for any comments.

Put a simpler way, is it only Companies House that can prosecute under the Company Act or is there an avenue for the public.
