  • Suspect Restructure of service whilst signed off unfit for work.

    Hi,

I'm hoping someone can give me a bit of advice on an issue i am currently facing. I work for a housing association in the west country and i am currently signed off as unfit to work by my GP. i have been off for several months now and have been prescribed medication and i am currently receiving help and support from the NHS re, therapies to help with my mental health and wellbeing.
i was recently contact by my immediate manager and invited to a meeting regarding a restructure in the service we provide. As i am a manager i was involved in the creation of the new restructure, but unfortunately became ill before it was finalised. I agreed to attend this meeting as i want to be as productive as i can whilst away from work and also because i do not want to be seen in a negative light by my employer. I have kept my company up to date with my health and wellbeing from the very beginning and my manager is aware of the issues i currently have. Low mood and depression. So to cut a long story short i attended meeting to be informed that my post was being deleted and the a new post was being created that was ring fenced and i and another manager would need to apply for. unfortunately this post is above my experience and practical abilities i.e is requires a driving licence which i do not hold as i have never taken my test and also the other manager has been an area manager with our company previously.
So, and i do apologise if this is not how forums work etc. This really is my first time. I would like to know if i have the right to ask to see details of the restructure where it was agreed that mine and my colleagues post should be deleted. we have charitable status and a committee and board members etc. I am assuming that such a restructure would need to be agreed by the board and therefore there should be minutes i can request to see? does anyone know if they can refuse me this and if these are not available/don't exist am i entitled to ask when the decision was made and approved by our chief exec and finally have my rights as an employee been breached re being informed of such information regarding my continued employment whilst deemed unfit to work.

Hi Simion76, & welcome to Legal Beagles.

Putting the right for information to one side just for the moment, are you suggesting, or do you suspect, that the 'restructure' is merely an excuse to oust you out?
