  • Pregnancy and request for home working

    Hi, my wife is pregnant and has just started maternity leave. Before this she was finding it difficult to go into the office and work due to a issue arising from the pregnancy. Her role and contracted position means that her job could easily have been done from home with the need to go into the office occasionally.
    She requested this and was refused, instead being told that the only job she could do would involve working on the sales floor or to go off sick.
    This she couldn't do not just because of the pregnancy related issue but as the employer knows she had a pre existing medical condition which means she couldn't work on the shop floor due to the long periods of standing.
    As such due to the reaction she got signed off sick by the doctor which now it comes to light is effecting her maternity pay as she only received SSP when off sick and this is meaning she only gets half what was expected.
    She wanted to work not go off sick and the manager didn't supply anything in writing to her explaining why she couldn't work from home, no other reason was given in regards to why only the sales role was given apart from they need everyone pushing sales at the moment.
    The issue relating to how SSP would effect her SMP payments were not explained to her until the day before her first payment for maternity was due and as such now is told she has to go to the job centre to claim this and as such wont be paid tomorrow (as such meaning she is going to be financially effected due to bills etc).
    We have set up a meeting with the employer in which the line manager who made these decisions isn't present and we are discussing with the HR and higher management but before going in I was looking to get some advice. I have told my wife to also get advice from ACAS on this as well but wondered on others opinions. This sounds to me like it is not correct and handled badly but I could be wrong.
