    Hello,
    My partner and I purchased a used 2005 Peugeot 307 1.6l from a local independent car dealer for £3100. When the car was sold to us, it was provided with an MOT without any advisories at all. We paid on our credit card and drove away.

    Three weeks later, when driving along, the exhaust from the car fell and dragged along to road. Upon taking it to a local garage, they advised that the entire underside of the car is rusted and heavily corroded, with a clamp and pin missing, and hanger heavily rotten which one has come off as its so rusty, and one off-side track rod end is insecure. None of this was mentioned to us by the seller, nor the MOT report, when we purchased the car.

    We took the car back to the dealer today who offered to replace the exhaust for free with a brand new one, and fix the issues. However, we are unhappy that the car was sold to us in this condition in the first place with such heavy corrosion, so want to push for a full refund. However, if we were to pursue this with a dispute/Section 75 claim, would the adjudication fall down on the side of the seller as he has offered a repair? Or, could we still have a chance to contest the issue by saying that the car was mis-sold to us and, had we known of the issues with the vehicle at the time, we would never have purchased it?

    The seller is inspecting the car overnight.

    You say "provided an MOT without any advisories".
    Does this mean there were advisories (check here https://www.gov.uk/check-mot-history-vehicle‎) but you weren't informed of them?
    Was the testing station the one at the garage? How old was the MOT?
    The seller, being a dealer should have advised you of any advisories. However if it was an old MOT any one could have removed the advisory sheet.
    On the other hand you appear to have been sold goods which weren't of satisfactory quality, and if that is the case you are entitled to your money back under SoG.
    Second hand goods are not exempted, except in regards to faults which have been pointed out to you before purchase.
