I have been liaising with Equita for the last few weeks with regards to an unpaid parking fine. There was a lot of discrepancy over paying the fine (car was hired, I got charged fees in additition from car hire ppl - this confused me).
I received notification (that I had not read properly) from Equita that they have been instructed to recover debt.
I received a letter from Equita telling me that the case is now managed by a bailiff who will visit within 3 - 4 days to remove goods or my car (the letter did not outline how much I owed, but did state that in the event the bailiff come back may incur further charges of around £140).
I called the bailiff, txt and left messages on his phone for about a week and a half, unsuccessfully. I eventually called Equita directly, informed them of my attempts to pay, also asked them to authorise my mum to pay on my behalf and asked that THEY get the bailiff to contact me. I also as a precaution confirmed the amount owing as £144.28.
A couple of days later, the said bailiff called me. I confirmed with him that mum would be paying AND the amount. As I was at work, He suggested he call me back. I never heard anything. I tried calling (admittedly) once or twice and left it for him to call.
It has now been about three weeks. I have received another letter of intent this time with a different bailiff to call. I contacted him immediately, ready to pay and have been told I now owe £557.00.
I explained to the bailiff that this was already being managed, and do not understand how I have incurred more charges when they have been the difficult ones to get ahold of. Bailiff informed me that there are no records of any discussions between me and the previous bailiff and it doesnt matter anyway because he HAS visited my property (even though I wasnt there).
I did not pay! After a few trips around the houses, Equita finally explained to me that my original bailiff, Mr French, no longer works in the area so my case was passed onto Mr Douglas.
My arguement currently stands that the fee has not been settled through any lacking on my part. I went above and beyond to clear the debt.
I'm not clear how I am supposed to have known that Mr French was no longer involved, especially as he had not been the easiest person to get ahold of.
I confirmed the price with both Equita and Mr French, and yet neither made note against my case.
Mr French left my case unresolved and had not made a reasonably effeort to sort this before he left - is this my fault?
I appreciate that Mr Douglas is trying to get me to pay for his visit, but again is this my responsibility?
Since reading the forums I have emailed Equita outlining my complaint and sent a further email requesting a breakdown of charges.
I would really appreciate some help as I have no clue as to what legal footing I have. this does not sound legal to me?!
