  • Desperate advice/help needed with MBNA & DCA hounds!

    Hi Everybody

    I am looking for some advice on a subject I know has been crossed before on the forum. I have read a lot of the posts concerning MBNA selling existing debts to Debt collectors but unfortunately I get completely lost when it starts coming to all the terminology used on the forum.
    Basically my story is much the same as many other people's, I have an MBNA credit card, I lost my job and tried to inform them but they wouldn't play ball and absolutely hammered me with charges, etc. I did the worst thing and buried my head.
    For the past few months I have received roughly 3-4 phone calls (minimum) a day from a DCA that has taken on the debt and loves bullying me. I haven't answered the phone once but they have left numerous voicemail messages and have sent some nasty text messages telling me to call asap..they even sent me a text message on my birthday telling me to contact a phone number as soon as possible because I had won a prize!
    I haven't received many letters from them but any I have received have been buried in the sand, next to my head!
    I have now just received a letter which is threatening court and I really don't know what to do.
    I am struggling to know the best way of going about it all if I'm honest and would really appreciate some straight forward advice.

    I have read the post 'Dealing with DCA's' which is stickied and have considered sending the first letter titled 'Prove I'm the debtor'.
    Is this the best thing to do?

    I know I haven't given a large flurry of information like many others have before which means you cant be entirely specific when it comes to my problem but if need be, I can track down anything which means someone may be able to help.
    I cannot stand it any more and have decided I need to stand up to the debt collection agency but would like to know the best way of going about it.
    I think I still have the old, deceitful text messages about winning a prize, could these increase my bargaining power or maybe where I stand against them?
    Any advice would be great and I'm sorry it will have to be in Lamens terms but I am trying my best to pick up the lingo. Its somewhat overpowering when it comes in force! haha

    yes send the prove it letter and the telephone harassment letter for good measure.

    Report the DCA to the office of fair trading as 3-4 calls a day is harrasment. and they should not be sending you text and certainly not ones making false claims of winning prizes.

    I have History with MBNA credit card issues myself, and scared the crap out of them so much the default on my file was removed and debt written off when i challanged/invited them to take me to court - But don't do that yourself, as mine and your situation my be different, but we will work on getting them off your back for now.

    Whos the DCA by the way? Don't be afraid to name them!
