  • Parking eye threats.

    Hi everyone. I'm new to this site as I am having certain issues. I hope some one can help.
    In august this year whilst on holiday, I and my family parked in a car park in Newquay and bought a ticket. After meeting up with friends we returned to our car and left.
    On returning home after our holiday we had recieved a notice from parking eye with photos of our car entering and leaving the car park.
    The letter stated that we had either not purchased a ticket OR had over run the time paid for.
    I emailed them stating that we had purchased a ticket and that I did not accept their invoice.
    The next letter we recieved was the same format but this on stated that we had over run our time by 32 minutes. As the ticket machine didn't require a registration number input how do they know? Also since we told them we bought a ticket their statement now says thatwe over ran the time paid for, not one or the other.
    We have now received 3 more letters, the lastest of which states that "the consequences of not paying, and subsequent legal proceedings, are that a judgement may be obtained and if ignored, appropriate enforcement may be taken."

    The original sum demanded was£60. This has now risen to £120.

    What should I do???

    It appears Parking Eye aren't entirely sure that you have done anything wrong. If they can't make their mind up, I would not pay them a penny. DO NOT pay them the penalty. They are not entitled to this. They already have a court judgement that left them around £5,000 out of pocket in which the judge struck-out their penalty charge and their solicitors' fees. Do not be swayed by their threats.

      It wasn't till I emailed them that I had bought a ticket that they decided that I had gone over time. How they know is beyond me.

        Don't the photos show the date and time on them? If not then the question is, why not? And throw section 2 of the fraud act 2006 "False Representation" at them for good measure!

            Thanks for your reply. Yes, they do show the time and date. They are saying that Either I failed to buy a ticket or that i over ran the time paid for. They didn't state that i had over run the time paid for until my e mail stating I had bought a ticket. You can be sure I keep all parking tickets from now on.
