  • FOS refuse PPI claim

Recently submitted a case to Financial Ombudsman after RBS refused my claim, I had a received refund from Tesco Credit card using the same evidence. FOS have refused my claim as the claim was referred to them 6 months after the final response to the complaint, the response was received in November 2011. I had previously made a claim in 2009 but due to new guidance following the Banks losing the legal battle I decided to try again. FOS will deal witth the complaint if there are exceptional circumstances for the delay. I'm not sure whether to pursue this via the FOS or use a claims company. Grateful for any advice on how to proceed, I believe RBS are being difficult because they sold the debt to a collection agency, Westcott

Hi Laplage, and welcome. If the final response was in November 2011, then the 6 months has not yet elapsed, so I don't see why the FOS have refused it.

I certainly wouldn't suggest that you use a claims company, as I doubt they will get any further than you have - but they may well still bill you for the work.

      Hi and welcome

Contact them and ask them why they will not pursue, as the 6 months have not elapsed your in your right to have this looked into.

I agree with Bill, forgot CMC's.
