    Hi all,Great to find forum hope someone can help me.Equita bailiffs chasing me for 2 parking fines,they want £360 for both of them,only
    received letter from them wanting £95.44 then letter with no amount on.
    On speaking to them on the phone now want£720 in total!any help would be greatly appreciated.

      Thanks for reply labman,am not sure bout ccj but got letter from Equita saying that
      warrant had been issued by traffic enforcement centre thru' northampton county court passed to them.Having moved homes since tickets have lost track of alot
      of paperwork.Havent heard from northampton court as tickets issued in Carlisle tho'

        Does this mean that important paperwork has ended up going to the wrong address(es)?

          Trying to find anymore paperwork at moment not much success, if have had ccj do you think
          i can do to avoid them taking car or repaying this extortionate amount they're asking for?cheers

            I would be extremely surprised if that amount does not include unlawful charges. Also, please do not worry about them taking your car at the moment.

            What I'm trying to work out is the correct way forward to stop them. If paperwork has gone to the wrong address, then the next step is fairly straightforward.

                Phone 08457 045007 and ask for the forms for a Statutory Declaration, Out of Time. File this and keep two copies, one for you and one to give to the bailiffs as proof you have filed the forms. You need to tell them (and be prepared to provide proof) - they should then back off.

                Once filed, the TEC will notify the local authority and give them 19 days to either accept or reject the application.

                If accepted, the application will be treated as 'in time' and the court registration will be revoked. The matter is then returned to the local authority who then decide on their next court of action (the fine is also reduced to the 50% again through all of this).

                If rejected, the application will be referred to a court officer at the TEC for an impartial decision to be made.

                As grounds you might consider:

                paperwork being sent to incorrect addresses.

                not knowing how much you needed to pay due to conflicting amounts, or no amounts on letters.

                unclear / no breakdown of charges - suspect charges are unlawful.

                moved homes a lot, so you have lost track of where things stand with regard to this issue.

                Anything else you can think of.

                    Re fees - the following are legitimate:

                    Sending a letter £11.20 (Can only be charged once)

                    Sum up to £200 28% (Minimum fee of £28.00)

                    Any sum over £200 5.5%

                    Bailiffs can charge fees for a maximum of three visits.
                    It is illegal to charge multiple fees for recovering more than one ticket in one visit.

                      Hi labman,thanks for all advice about statuatory declaration and out of time,returned forms;got letter from TEC saying returned to city council and have to pay £50per ticket!Have done hpopefully resolved.Big cheers.
