    British Gas referred me to debt collection/credit ratings agencies in error. Only discovered this after knock-back for a loan, first time in my life. British Gas admitted their mistake in writing. Specific query - Breach of data protection? I say yes, they say no.

    Hello Zeitgit and welcome to Legal Beagles.

    I am going to advise you to contact the Information Commissioner's Office (ICO) on this one, as they will be able to tell you, either way, whether British Gas has breached their obligations under the Data Protection Act 1998 (as amended). If you have suffered financial loss as a result of BG's blunder, you may be entitled to recover this from BG. Please be aware, however, that the ICO has some awesome enforcement powers, including the power to fine companies who breach the DPA up to £500K. You should speak to the ICO's Helpline to start with - they can get busy - and then go to their website to download a complaint form.
