  • Redetermination hearing on Friday

    Hi, I have a redermination hearing on friday, as Hillesden Securities have rejected my offer of payment. They are just one of 6 other debters that i have been paying £1.00 a month too for the last few years. I owe 3k which was originally a debt with MBNA. Due to my financail circumstances, £1.00 a week was all i could afford. All other creditors have accepted this, and are quite happy with this amount, one of them i actually owe 10k to, and they seem to accept £5.00 a month from me. I have never missed a monthly payment to any of the creditors. Hillesden said they will reject any offer as they want to put a CO secured on my home.
    Can they do this? I read somewhere that it would not be granted if it puts the other creditors at a disadvantage, which obviously it would, especially the one that has 10k owing.

    What happens at these redermination hearings? Do i get a chance to explain how i got in this mess in the first place. I have continued to pay hillesden while waiting for the court date.

    So how do i defend this? Anyone been through this before? Any advice would be appreciated.

      You really need to get a Common Financial Statement completed as soon as possible. If you have no disposable income available there isn't much point in HS pursuing the route they're taking I wouldn't have thought as you're doing all you can.

      They cannot just say they won't accept any offer as they want a CO against your house as this is contrary to all guidelines. They are obliged (or there is significant pressure on them) to accept the results of a CFS. I imagine this would have been done 3 years ago and it should be reviewed regularly.
