  • Civil Restraining Order

    hello,

I need to apply for a CRO against a persistent County Court Claimant who is presenting scurrilous and vexatious cases. (another 4 of them thrown out by the Judge recently off his own back due to their ridiculousness)

Am I right in thinking it is an N244 form and £80 or is there another way to avoid having to pay as this claimant is making life a misery.

    thanks.

Trying to think out of the box here

Don't know if this would work

    but

how about you sue them for harrassment and go for compo, on the grounds of repeated claims that can be proved to be ridiculous (Assuming they can be proved as ridiculous) to try and put a stop to them making daft claims that the judges throw out

I duno if it would / could work

    others please comment

You may instead want a Grepe v Loam order, which forbids them from commencing litigation without the express permission of the court. This is the usual remedy against vexatious litigants.

As far as I am aware a Civil Restraint Order is what was formerly known as a Grepe v Loam order.

Weren't Grepe v Loam's used to stop more litigation being launched whilst proceedings were ongoing?
