    Hi,

    wonder if someone can help.

If someone has an 8 hour contract (local Council) but has been working a 37 hour week (paid as normal salary, not overtime) for 6 years have they gained any extra rights? its a bit of a complex situation regarding redeployment etc, just wondering if there's any documentation that might help us out to say they are entitled to a 37 hour contract?

    thanks

When the contract was signed, did it stipulate entitlement to breaks?

        Employment law is rarely simple.
