County Court procedural error?

  • County Court procedural error?

    hello,

    If this is in the wrong section can a Mod please move - thank you.

    I am in County Court in 5 days time as the Claimant.

    The Defendant has issued me, and a copy to the court, of documents she intends to rely on in Court. However, these documents are well outside the exchange of documents date and have been written after reading my Claimants documents in an attempt to rubbish my submission.

    The Court tell me the papers will just be added to the folder that goes in front of the Judge.

    Now, I believe they should not be allowed. Is there a standard procedure I can follow to ask that they be disallowed or any CPR's that I can quote?

    Had you considered making an application to the High Court for an order Quare?

      Are these new documents to be produced in evidence or just fresh statements of defense.

      TBH In any event, I would expect a judge to admit any new evidence if it helps him come to a just conclusion. I have heard of new evidence being admitted during a hearing!!!
      They were out to get me!! But now it's too late!!

        These new documents have been prepared after the defendant read my submission at the 14 day deadline.

        The documents are an attempt to discredit my submission and are full of lies.
