  • DOORSTEP VISIT THREAT - MacKenzie Hall threat letter

    I have just received a letter dated 22nd April that says:
    "Despite repeated efforts to contact you (they called me while I was on holiday abroad and I have had my phones switched off), we have still not received a response.

    Therefore we may have no option but to sanction a Doorstep visit to your property by our field collectors Meritforce.

    Alternatively we may advise our clients to issue a Claim against you in your Local Court.

    If judgment is granted the following may apply:
    - Your debt being increased to include Legal Costs and Interest
    - Your name being entered in the Public Records of your Local Court.

    Failure to satisfy the judgment, if granted, may result in further enforcement action being taken against you.

    To avoid of this action, payment must be lodged at this office within the next 72 hours. If this is not possible please contact ....... on ...... imeediately. "

    1. I had a loan with Quick Quid. While i was under debt management with Baines and Ernst i was paying them 60 pounds a month towards the loan. They have never officially agreed to the payment plan - that was what i was told by B&E.

    2. I left Baines and Ernst cause they charged me 97 pounds a month and did absolutely nothing, i constantly had to complain to them about the fact that i still receive phone calls from lenders, that my interest has not been fully frozen and that some of them receive the payment by cheque, not by transfers despite the fact they offered to provide the bank details.

    3. Quick Quid did not want to agree that I continue to pay 60 pounds a month, They wanted 200 pounds a month that i cannot afford. All other lenders agreed to accept the sums as negotiated previously by Baines and Ernst.

    4. They refused to speak to me and then they sent me an email informing me they sold my debt to MacKenzie Hall, but they have not provided them with the right balance. The one stated on the letter has NOT included all the money i have been paying for few months.

    5. MacKenzie Hall guy who I spoke to on the phone (he called my office number) was rude, arrogant and did not want to let me speak or explain. I said to him that i do not see a point of continuing the conversation and I hang up on him.

    6. No they sent the letter.

    Could you please advise me how to proceed, what my rights are and what can happen next?

    I will much appreciate your help.

    In addition - I tried speaking to them to advise them again that the sum they are claiming is incorrect. The woman on the phone was rude (must be their policy!) and she accused me of shouting at her and hang up on me. They bought the debt from Quick Quid, but they do not want to go back to them to check the correct balance, they want my bank statements and I will NOT provide them with any personal papers or information.

    Can someone advice me though what should I do when someone from Meritforce comes to my house?

      Send Meritforce the 'Trespass Rule' letter:


      Dear Sir or Madam,

      Account Ref xxxx

      Please be advised that I will only communicate with you in writing. I have noted your repeated attempts to contact me by telephone over the past few weeks/months and these have been duly logged by time and date.

      Furthermore, should it be your intention to arrange a “doorstep call”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.

      There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

        ROFLMAO.
        ANYTHING from Mucky Hall should be filed under IGNORE.

        Do NOT respond to them, ever, as it only encourages them.

        Mucky Hall specialise in statute barred and completely unenforceable debts that no one else wants or can be bothered with..

        IF they do turn up, which is highly unlikely, simply refuse to answer any pf their questions and tell them to leave your property.
        remember the Pizza Dude has more rights to call on you then these doorsteppers do

          Thank you guys! I really appreciate your help. I really panicked when I saw their letter and now I am calmer and more confident I can fight those terrible people. I am astonished that people who work for MacKenzie Hall can live with themselves after making those humiliating, rude calls.

            Well the ordinary person would probably panick (we all have @ some time) due to lack of knowledge, these people thrive on that and make a lot of collections from threats, so in this case as Curly says ignore them.:beagle:

              Going back to your DMP we talked about, have a read of this new section on managing debts yourself.....really useful and proves why companies like B&E are totally useless, especially when you do a far better job, just don't be anxious...you can do it!

                I did do it! I contacted all lenders and all of them (except one that sold my debt to MacKenzie Hall) agreed to the same amount I paid via Baines & Ernst. They were very understanding and didn't cause me any problems.

                4 of those debts I will pay off in full at the end of June as I get a little bonus and the balances are really small now, so I am really happy about leaving B&E, those *******s charged me £97 admin fee per month and DID NOTHING! I was still being harrased by lenders and they did not freeze the interest!

                    A couple of years ago I dealt with mckenzie hall and they went so far as sending meritforce to my door. But as I live in a block of flats with intercom they couldn't even be bothered to call my flat but my neighbour who didn't let them in. If they turn up just ignore them. I haven't heard from them since then....but who knows??

                      £97 a month???!!!!!

                      This is why CMC are to be avoided. Your creditors have (mainly) agreed to your previous payment plan, and you are now £97 a month better off!

                      You can now put this towards paying off your debt more quickly, or alternatively, put it towards a contingency/emergency fund so that you never need credit again.

                      A massive cap off to you for taking things on yourself.

                      Muck Hall you can deal with like any other creditor.

                        Oh I forgot to tell you it's worthwhile to check with any neighbours as muck hall did send a letter to one neighbour of mine asking if I lived in the block, if I was working and if so, who for etc.
                        It is well known that some DCA's do send letters/contact neighbours asking questions.

                          OMG! I can't believe they would bother my neighbours. That is ridiculous! I am paying off debts (besides the one to Mucky Hall) and it is going well. From July I will have 4 lenders paid off in full, so more money for going out with my boyfriend

                          They just sent me another letter, here it is:
                          "DEFAULT ON FIXED SUM LOAN AGREEMENT REGULATED BY THE CONSUMER CREDIT ACT 1974.

                          We write to you for the final time giving you formal notice that Quick Quid has legally assigned the rights to the above debt to MacKenzie Hall Debt Purchases Ltd. This means that MacKenzie Hall Debt Pucrhases Ltd now legally own the debt.

                          We have been instructed by MacKenzie Hall Debt Purchases Ltd to consider legal proceedings against you in Northampton County Court for recovery of the full amount outstanding above, together with statutory interest and additional costs. If you wish to avoid Court action then you must pay the full amount within 7 days. There will be no further warning (in bold letters!)

                          Upon Judgement, enforcement action could be taken against you, whereby the following methods could be considered:
                          - attachement order on your salary
                          warrant of execution by the bailiff/sheriff officers instructed to seize your goods from your property
                          - charging order or bancrupcy may also be considered where applicable.

                          Your payment must be sent to MacKenzie Hall immediately. If you wish to pay by Debit Card or Credit Card or discuss the matter then you must contact our Litigation Team on 01563 556 544.".

                          Shall I respond by letter? Or is it one of those scary letters they sent to intimidate me and force me into paying it fully?
                          Also, what really annoys me is that despite me trying to tell them many times they do not consider is that the balance they are claiming is NOT correct. I have been paying Quick Quid money for few months before they sold the debt, so the balance is much smaller.

                          How is it going to end? Do you think they will agree to some kind of repayment arrangement, or will i have to keep avoiding them for another 6 years? That will completely distroy my credit history.

                            Aload of hot air really.
                            The only place you need to reply to is an actual court - nobody else.
                            Report these clowns to the OFT & trading standards if they refuse to go away.
