  • New European Human Rights Ruling / Rent Arrears

    Hi

Will it now be harder to evict council tenants who fall into rent arrears?

        To quote from the article:
"Legal experts said there was an increasing ‘trend’ for tenants – including ‘neighbours from hell’ – to use human rights law to thwart eviction"

I don't see it as a trend. As private tenant of 16 years, the use of human rights is a long-needed solution to so-called mandatory possession orders.

The Human Rights Act 1998, along with the Magna Carta 1225 onwards, represent our most fundamental rights and freedoms in the English constitution.

That is why they cannot be over-ridden (repealed) by later laws, unless the new law expressly does so.
