Re: Deposit on a second hand car which was a write off

If it has been repaired properly and the vehicle is in a roadworthy condition, you will not have a claim against the seller unless they gave a misleading description of the vehicle. For example, they might have said it was in first class condition, had one careful owner, or was totally perfect, when none of this is true.
If you bought the vehicle from a dealer and they gave you a misleading description, they may have committed a criminal offence.
If you bought the vehicle from a private seller and they gave you a misleading description, it may be possible to take legal action against them.

Thanks for that Caspar, this is why I asked if the OP had a copy of the original advertisement for the car.

Re: Deposit on a second hand car which was a write off

      Hi All,

I wanted to give you all an up date - the process I followed was like this ;following my request some 4 weeks ago nothing has happened - it's more about principle now.

So last week I hit go on the court paper work online and am waiting on a defence. I managed to get a bit more out of lawyers today and it would look as though the Trades D Act is the best bet as such a" label" on a car can have a dramatic effect on it's price and ablity to resell and this was never disclosed and as such it should have been - essentially they were selling the car at it's market price without such a "label" when it would be worth about 15% less in it's current condition

So I now wait the dealers defence and yes I have the advert and have kept a copy

many thanks for all the help so far
