  • How to strike off a claim that was stayed a year ago?

    Hi all,

    Another case I'm afaraid...
    1st Credit finance took me to court on 15th May 2009. 8Th june 2009 letter from court acknowledging my defence & if 1st Credit Finance do not do anything the case is stayed. I called a couple of months ago & they say the case was stayed & i need to strike it off now before they asked court to re-surrect again. I know its the form N244 but what do I say?

      If they havent had the decency to move the matter forward (as they inistigated the action in the 1st place) then the 244 should request that the matter should be struck off as they have had ample time and are now (find suitable words) wasting the courts time with this (in) action..

        Just be aware that applying to strike the case might get their arses into gear with taking it forwards so I'd wait a little while till things are a bit calmer for you and have a look at the case fully so you are prepared with what to do in the event they do respond.
