  • Can disputed debt be assigned

    Hello
Whilst I was in the middle of separate disputes with Egg credit card and Goldfish credit cards, Egg and Goldfish sold my account to Cabot. Cabot have now made a county court claim against me for the two disputed debts.

My understanding is that the OFT Debt Collection Guidance does not permit disputed debts to be assigned (e.g. debt collection activity must cease whilst a disputed debt is being investigated)
Does anyone know if Cabot/Egg/Goldfish are permitted to ignore my complaints, and just carry on as if the debt is not disputed by me?

    Thanks for any advice.

I am VERY new to all of this, so don't just take my word for it, but I was of the same opinion as you that while under dispute things had to stay as they are until the dispute is resolved.

It is against the OFT 664 guidance for debt collection and the lending code but its not law (nor regulatory in bcobs either)
