    Can someone help me.

    We had a loan with Tesco which we paid religiously up until 2008 when our circumstances changed and we fell into arrears. We tried to negotiate with Tesco who refused to answer correspondence and they instructed Triton, who then passed to Moorcroft, who then passed back to Triton. The Incasso became involved and refused to consider reduced payments and eventually issued court proceedings through Northampton. We asked them for a copy of our full terms & conditions which they refused to supply and ignored our letter asking for full documentation so we could prepare a defence.

    Yesterday we had a form from Cobbetts stating they were now acting for Tesco and refusing to accept offers of reduced payment stating they were seeking the full amount of the rest of the loan. I dont know what to do next.

    We submitted a partial defence admitting the amount but Incasso were in default for failing to provide the information requested within 28 days.

    Can someone help and sorry if this is garbled.

    Hi Alexandra

    Can you type up the wording from the claim form (exclude your account number etc)

    Do you have copies of letters to Cobbets, Tesco & Incasso offering reduced payments and asking for information ?

    Also if you can can you post up the partial defence/admission/offer to pay you have entered, and also I'm not sure from your post if default judgement has been given against you already and Cobbetts are collecting on a judgment debt or if it is still in court awaiting a full defence/documentation so the dates would be great there.

    Then we'll have a better picture and be able to help with the next steps.
