    hi all hope someone out there can give me some help, we had a letter from a building firm to inform us of work being carried out on the property next door to us, stripping of old roof and timbers and renewal this is a big property a gospel hall, we agreed to the work being done and thier surveyor came round and talked to us about the work which would last 8-10 weeks, we didnt realise at the time how intrusive the scafolding would be ie blocks out light in the kitchen and dinning room, is level with the rear bedroom which we have to go through to get to the bathroom so we have to keep the curtains shut in the mornings, it intrudes on our patio giving us less room to use, and now the mess and dust it is causing inside the house black dust all over the living room and carpet that will not come off, i know that the work has to be done but are we entitled to any compensation for the inconvenience it is causing ? help please colin.

      thanks for the reply.. we agreed to the works proposed, the scafolding was errected while we were on holiday had we been here we would not have let them put so much up, i still have the copy of the letter if this helps,

        So has the scaffolding gone up higher than agreed? If yes, you need to speak to the building owner as soon as you can in order to have the situation rectified back to what was agreed.

          no there was nothing agreed to the height of the scafolding or anything else come to that we have been little bit nieve as to what to expect, as when thier surveyor came to visit us didnt tell us either. we was not expecting it to be as invasive as it is

              Was the notice made clear to you that it was being served under The Party Wall Act 1996?

              I think the long and short of it is that you agreed to the work and although it's inconvenient, it isn't causing any tangible loss, such as earnings.

              You could always appoint your own surveyor. Have a search on here for your area and see if there is an engineer/surveyor near to you whose brains you could pick for 10 minutes Pyramus Thisbe most of them are quite amenable.

                  If this was a formal Party Wall award then you would have been appointed a surveyor before anything was agreed.

                    we were never given an award, so this new surveyor is looking into it will let you know outcome as a matter of interest,
