  • Me against GE - next step

Quick run down of where I am and to ask what I do next.

Went to court in March, judge said to submit witness statements by 24 th March, GE to respond 31st March, list for hearing first available date after 14th April.

Just spoke to court as sent defence by 24th, not received anything from GE, where do I go from here. The court didn;t really have a clue. Theyc ouldn't find the file at first and the judgemenment made on 17th March still hasn;t been typed.

Where do I go from here in respect of they haven't complied with the judge, thanks

Re: Me against GE - next step

Background is. Claimants GE applied for repossession on my brothers property in Oct 2008. He went unprepared and they listed it for another hearing in December after he sought advice. He and his partner went back with no real defence again other than they had fell behind with repayments and GE wouldn't accept offer.

Suspended possession order granted with a review hearing in 3 months.

Attended review on 17th March, this time with arguments against figures claimed by GE as well as inconsistent credit agreement between claimants submission and original held by defence.

Judge only had 5 minutes as case was only listed for a review. Judge ordered witness statements to be submitted by the defence by 7th April with GE by 14yj April and 1st available court date after 30th April I am acting as brothers litigation friend and asked if dates given could be brought forward as I am leaving the country for 2 years with my husband who is in the British Army on 19th May. Judge brought dates forward to 24th March, 31st March and review after 14th April.

I ensured that the witness statements were received by the court and GE solicitiors on 24th March, I have not received anything from them yet and it should have been received yesterday.

Will it just be accepted that it could be late? Thanks
