dwp claiming money from estate

  • dwp claiming money from estate

    the dwp are claiming money from my father in laws estate because they say that his savings were to much to claim the pension credtits that he received.
    The money that he saved came from the benefits that he received he did not smoke or drink and had virtually no social life due to depression and other mental issues.
    Does anyone have any advice on appealing this decision ?

    Hello geordie,
    This link is to the Pension Service site, it gives all the criteria for claiming pension credit.
    If you have a read through that it may give you an idea of his entitlement.
    There also maybe information on there or a number you can ring to help you further with how to appeal the decision. It seems sad that the very benefit he was awarded also made him have too much savings to get the benefit.

      How much are the asking for?
      Is there enough from the estate to pay it back?
