    I was in a fast food place a few days ago and got accused of filming children. While I did film I did not film any children or adults come to that just empty stools and the floor. Someone placed a video of me together with my distinctive car and number plate on social media, I contacted the Police who came out, looked at the footage and declared no laws were broken.

    I was initially told to sit low, ask FB to remove the posting and not stir things up. However nine days later the posting is still up, now the video has been shared many times, most people I know have seen it. Some people have posted comments that I am know for such things, that I sit on a flat roof and stare at children in a day care centrer next door, that I have been reported many times and because of me one women writes her child had nightmares for months, non of it true.

    I have been trying to get the police to issue me with a incident report which I could copy or for them to place a message on their web site that the matter has been investigated and there is no truth in the postings, but I have been having difficulty getting them to do this, anyone with advice? some people have said if it was not true the police would have took the posting down,

    Secondly if I were to sue at some point what should I be doing now.

    Why were you filming the floor and empty stools ?

    The video that was posted on social media of you and your car / licence plate was it accompanied with any comment that instigated the further comments ?

    Why, because i wasn't meaning to.

    Comments with the video "Look out for this scumbag, caught him staring at a group of young children. Then caught him approaching them whilst filming it on his phone."

    Sorry to say in this day others will be thinking your filming children you need a long hard think about any action you take

    Have you actually reported the post to FB?? or did you just email them?

    My point is its easy for others to think this I know I would mobile devices often are used to film others without their permission for what reason I don't know nor would those who were there

    Its just a time were theres a cross over between people abilty to record others easly, and people geting more concerned about the use of recording of them selves or familys. Unless your recording family friends in an open mannor, its not cool to record in a puiblic place without getting others permission.

It is neither illegal under civil or criminal law to film in public, unless an establishment forbids it then it becomes a civil matter between the establishment operators and the person filming.

    Yet the guy who objected to me filming, filmed me and put it up on social media without my permission!!! I filmed no one!

    I showed the footage to the manager, I reported it to the police who reviewed it and declared no law was broken and asked for the post to be removed, yet it is still there, along with text and comments on video.

    What about dash cams and CCTV?

It is neither illegal under civil or criminal law to film in public, unless an establishment forbids it then it becomes a civil matter between the establishment operators and the person filming.
    This wasnt a holiday place, it was a fast food place. Am a parent, i would expect/insist you to get my permission prior using a camera in a public place were my childeren are.

    If i see another family filming there kidcs/party, no boither, if i see young people, filming each other, fine, no issue if they film my kids accidently.

    Singleman or woman,,, nope, not ok to film in a public place were my childeren or i am, without my permission.

    Can i ask, What was you intending in filming ? why

    Getting away from whether or not your filming was inappropriate (which the police have confirmed was not) can we return to OPs question of what he can do about defamatory statements on facebook?

    It seems to me that the postings are possibly malicious communications and the police should be taking action. If they aren't insist on speaking to a senior officer or write a formal complaint.

    I'm not on FB but I understand they have a help centre where you can report such posts and get them taken down. You say this has been reported but FB haven't yet taken them down. Again make a rormal written complaint.

    You could also consult a solicitor about the possibility of bring a n action for defamation against these posters.
    Would be expensive, but the threat might be enough to have the posts removed.

    Hopefully others on here will be able to give you the advice you need to have these defamatory posts removed.
