  • covenants?

    Hi,
    I have copied the below from a title register I recently downloaded from HM Land Registry, can someone please explain what section (b) means?

    (b) That except in accordance with Plans elevations sections and specifications previously approved and signed by the Agent for the time being of the Vendor or his sequels in title and by such Chairman for the time being as aforesaid no building should at any time be erected and no alteration or addition should at any time be made to any building at any time erected or standing on the said piece of land or any part thereof and

    1 (20.03.2017) A Conveyance of the land in this title and other land dated 18 September 1913 made between (1) The Most Noble William John Arthur Charles James Duke of Portland K.G. (Vendor) (2) Edward Horsman Bailey and others (Trustees) and (3) The Intake Freehold Land Society Limited (Purchasers) contains covenants details of which are set out in the schedule of restrictive covenants hereto.
    2 (20.03.2017) A Conveyance of the land in this title dated 10 December 1923 made between (1) The Intake Freehold Land Society Limited and (2) Ellis Ward contains restrictive covenants. NOTE: Copy filed.
    Schedule of restrictive covenants
    1 (20.03.2017) The following are details of the covenants contained in the Conveyance dated 18 September 1913 referred to in the Charges Register:-
    COVENANT by the Purchasers their successors and assigns with the Vendor and his successors in title under the said Indenture of Settlement their heirs and assigns owner or owners for the time being of Welbeck Abbey aforesaid (thereinafter called his sequels in title) and as a separate covenant with his Trustees their heirs executors administrators and assigns in manner following that is to say:
    (b) That except in accordance with Plans elevations sections and specifications previously approved and signed by the Agent for the time being of the Vendor or his sequels in title and by such Chairman for the time being as aforesaid no building should at any time be erected and no alteration or addition should at any time be made to any building at any time erected or standing on the said piece of land or any part thereof and
    (c) That no noxious or offensive trade should at any time be carried on upon the said piece of land thereby conveyed or any part thereof or upon any building which might at any time be erected or stand thereon and that no wine beer or spirits should at any time be sold upon the said piece of land or on any part thereof or in or upon any building which might at any time be erected or stand thereon.
    NOTE:-The Indenture referred to is dated 2 August 1879 made between (1) The Most Noble William J. Cavendish Bentinck Scott (2) William Arthur John Charles James Cavendish Bentinck (3) Edward Bailey and (4) Arthur Charles Greville and Edward Bailey. End of register

    Hello Ben

    Section (b) would appear to suggest that the Vendor is not entitled to erect any building or make alterations to the existing one which sits on the land in question unless it complies with the plans, elevations, sections or specifications already approved and signed by the Agent (presumably the Vendor's conveyance/solicitor) and the Chairman (whoever that is).
